- Express Labs performs 4 Quarterly Computerized Random Selections in January, April, July & October to comply with DOT's Mandate to have a Minimum of 50% of Drivers Tested for Drugs & 10% for Alcohol
✅ How are Members Notified for Random Selections?
- Express Labs Emails Random Selections and Posts the Random Selections in Member's Express Labs Accounts in January, April, July & October
✅ What if you didn't receive an Email Notification?
- Check your Account on February 1st, May 1st, August 1st & November 1st.

✅ When are Driver Eligible to be Selected for Random Testing?
Only Active Drivers can be Selected. Drivers are Added to the Random Pool when Negative Pre-Employment DOT Drug Test Results are Reported by Express Labs MRO or when Added During Enrollment
- Can Drivers be Selected right after a Pre-Employment Drug Test?
- Yes, DOT does not want Drivers to have any assurances they will not be Selected again
- What if a Driver is Selected that has not been Hired?
- Deactivate the Driver and Notify the Re-Selected Driver
- Can Drivers be Selected Multiple times a Quarter?
- Yes. If a Driver is Deactivated who was Selected a Re-Selection is performed from your Remaining Drivers which may result in a Driver being Selected Multiple Times in the same Quarter
- Can Drivers be Selected Multiple times a Year?
- Yes. Each Quarterly Selection is Independent of Previous Selections, which means Drivers may be Selected up to 4 times yearly. Every Driver has an Equal Chance of being Selected each Quarter, regardless of whether they've been Selected in Previous Quarters. Some Drivers may be Selected Multiple Quarters, while others might not be Selected at all in the same period
- Can a Driver who was Selected be Reactivated after being Deactivated?
- DOT Requires a New Pre-Employment Drug Test if a Driver is Deactivated after being Selected for Random Testing
✅ Failure to Complete Random Drug and Alcohol Testing
If a Company fails to complete DOT Mandated Random Drug and Alcohol Testing, they can face severe penalties under the Federal Motor Carrier Safety Administration (FMCSA) and 49 CFR Part 382 Regulations and may be Reported to DOT and Terminated from the Consortium. The Fines & Penalties can include:
- Failure to Conduct Required Random Drug/Alcohol Tests: Fine: Up to $15,419 per violation. Employers must ensure that all covered drivers are included in a compliant random testing program and tested at the required annual rates set by DOT
- Allowing a Driver to Perform Safety-Sensitive Functions Without Completing a Random Test: Fine: Up to $5,833 per violation. If a driver is selected for random testing and does not complete it within the required time frame, they cannot continue working until tested
- DOT Compliance Reviews & Safety Rating Downgrade: DOT audits can result in a “Conditional” or “Unsatisfactory” safety rating if random testing violations are found. Repeated violations can lead to an Out-of-Service (OOS) order, preventing operations
- Increased Legal Risks: Lawsuits: If an untested driver is involved in an accident, the employer could face civil liability for negligence
- Potential Criminal Penalties: Willful non-compliance (e.g., intentionally avoiding random testing) could lead to criminal charges if an accident occurs due to drug/alcohol impairment
